We at Midlands Mediation are very aware of the commitments of the participants in ADR/mediation and where ever possible arrange mutually convenient appointments for all participating parties.  In my experience the physical presence of a participating party demonstrates their personal commitment to the process.

Within the ADR/mediation process participants, as identified by Di, provide each other with frank and open information, this often involves the exchange of documentary evidence of this information.  If ADR/mediation takes place &#039;over the phone&#039;, this is likely to result in a delay in this information being exchanged and circulated.  This would result in a longer process and frustrate the objectives the Minstry of Justice are seeking to achieve.</description>

		<description>I am all in favour of more effective and cheaper dispute resolution. In my opinon mediation works best where the parties either meet or are involced in shuttle mediation and can participate in a process. Negotiation works best where you can see the other parties involved and experience some empathy. I would be excptional to be able to replicate this over the telephone. It may be that telephone shuttling is more suited to settling debt type actions where there is less of a personal element to the matter.

		<description>In my view if people are really committed to using dispute resolution effectively, they will be prepared to turn up for a meeting.Phone based mediation could be used where on party is abroad I suppose, but I would want a video/skype link set up as it helps if each party can see and hear what the other has to say.

I appreciate that phone based adr could be helpful for people with disabilities who cannot travel easily,and for those with sight problems, but I would want there to be at least a conference call where all participants can hear what the others have to say.If anyone has hearing problems then a video link should be used.ADR&#039;s very foundation is based on all participants being frank and open with each other and that principle must not be compromised.</description>

		<description>Please remember the children!! They didn&#039;t ask to get divorced, and if you can maintain an amicable relationship, then how much better for all of you will that be?!

Mediation can help with resolving the practical arrangements as well as communication between you and your ex. Life is far too short to spend it in conflict with another person, and kids get caught in the crossfire all too often. So try mediation, at least find out about it what have you got to lose?</description>
