Many people in mediation find it helpful to discuss with their own solicitors both the information provided and the proposals being considered during the mediation process. Any financial information, which either of you provides in the course of the mediation, could be produced to a family court if necessary and appropriate this is “open” information.
All discussions over possible solutions are confidential between you and the mediator and may not be produced for court without the agreement of you both.
The Mediator is duty bound to make certain disclosures in exceptional cases, these are generally in relation to child protection issues which are referred to prior to Mediation.
